Number and qualifications of members; single-member districts; reapportionment

A. Senators shall not be less than twenty-five years of age and representatives not less than twenty-one years of age at the time of their election. If any senator or representative permanently removes his residence from or maintains no residence in the district from which he was elected, then he shall be deemed to have resigned and his successor shall be selected as provided in Section 4 of this article. No person shall be eligible to serve in the legislature who, at the time of qualifying, holds any office of trust or profit with the state, county or national governments, except notaries public and officers of the militia who receive no salary.
B. The senate shall be composed of no more than forty-two members elected from single member districts.
C. The house of representatives shall be composed of no more than seventy members elected from single member districts.
D. Once following publication of the official report of each federal decennial census hereafter conducted, the legislature may by statute reapportion its membership.

a. Senators shall not be less than twenty-five years of age and Representatives not less than twenty-one years of age at the time of their election. If any Senator or Representative permanently removes his residence from or maintains no residence in the County from which he was elected, then he shall be deemed to have resigned and his successor shall be selected as provided in Section 4 of this Article. No person shall be eligible to serve in the Legislature who, at the time of qualifying, holds any office of trust or profit with the State, County or National governments, except notaries public and officers of the militia who receive no salary.
b. The Senate shall consist of one Senator from each County of the State. In the event the number of counties is hereafter increased or decreased, the number of Senators shall be increased or decreased accordingly at the next election thereafter at which members of the Senate are to be elected.
c. Until changed as provided herein, the House of Representatives shall consist of sixty-six members, composed of at least one member elected from each County of the State, provided that the County of Bernalillo shall elect a total of nine members; the Counties of Chaves, Dona Ana, Eddy, Lea, McKinley, Rio Arriba, San Juan, San Miguel and Santa Fe shall elect a total of three members each; and the Counties of Colfax, Curry, Grant, Otero, Quay, Roosevelt, Taos and Valencia shall elect a total of two members each.
d. For the purpose only of selection in each County entitled to elect more than one member of the House of Representatives, there shall be designated by the officer issuing the election proclamation as many places, consecutively numbered, as there shall be Representatives to be elected in such County, and only one member of the House of Representatives shall be elected for each place designated. No County shall be geographically divided for the purpose of designating places in the election of such members of theHouse of Representatives. Each candidate shall designate, upon filing his petition, the position number for which he is a candidate, and the County Clerk shall so designate him upon the ballot.
e. Upon the creation of any new county, it shall be entitled to elect one member of the House of Representatives at the next general election following its creation.
f. Once following publication of the official report of each Federal decennial census hereafter conducted, the Legislature may by statute reapportion among the various counties the number of members of the House of Representatives to be elected from each County, provided that each County shall be entitled to elect at least one member of the House of Representatives, and that no member of the House of Representatives shall represent or be elected by the voters of more than one County.

The Senate shall consist of one Senator from each County of the State, except Counties of the sixth class, and in the event the number of counties is hereafter increased or decreased, the number of Senators shall be increased or decreased accordingly at the next ensuing election after such change. Senators shall first be elected under the provisions hereof at the election in the year 1952, to serve in the 21st and 22nd Legislatures.
The House of Representatives shall consist of fifty-five (55) members, and the representative districts and the number of members to be elected from each district shall be as follows:
First. The County of Valencia, two members.
Second. The Counties of Socorro and Catron, two members.
Third. The County of Bernalillo, six members.
Fourth. The County of Santa Fe, two members.
Fifth. The County of Rio Arriba, two members.
Sixth. The County of San Miguel, three members.
Seventh. The County of Mora, two members.
Eighth. The County of Colfax, two members.
Ninth. The County of Taos, two members.
Tenth. The County of Sandoval, one member.
Eleventh. The Counties of Union and Harding, two members.
Twelfth. The County of Torrance, one member.
Thirteenth. The County of Guadalupe, one member.
Fourteenth. The County of McKinley, two members.
Fifteenth. The County of Dona Ana, two members.
Sixteenth. The County of Lincoln, one member.
Seventeenth. The County of Otero, one member.
Eighteenth. The County of Chaves, three members.
Nineteenth. The County of Eddy, two members.
Twentieth. The Counties of Roosevelt and Delaca, one member.
Twenty-First. The County of Luna, one member.
Twenty-Second. The Counties of Grant and Hidalgo, two members.
Twenty-Third. The County of Sierra, one member.
Twenty-Fourth. The County of San Juan, one member.
Twenty-Fifth. The County of Quay, two members.
Twenty-Sixth. The County of Curry, two members.
Twenty-Seventh. The Counties of Rio Arriba and Sandoval, one member.
Twenty-Eighth. The Counties of Torrance, Santa Fe and Guadalupe, one member.
Twenty-Ninth. The Counties of San Miguel and Guadalupe, one member.
Thirtieth. The Counties of Lincoln, Otero and Socorro, one member.
Thirty-First. The County of Lea, two members.
Upon the creation of any new county, it shall be annexed to some contiguous district for purposes of representation in the House of Representatives. Senators shall be not less than twenty-five years and representatives not less than twenty-one years of age at the time of their election. No person shall be eligible to the legislature who, at the time of qualifying, holds any office of trust or profit under the state, county or national government, except notaries public and officers of the militia who receives no salary.
Should this amendment be adopted at a special election held prior to the next regular election, it shall govern and control the number, qualifications, apportionment and election of the membership of the lower house in the 1950 regular election.
That, that portion of Article IV of the Constitution of the State of New Mexico entitled "Apportionment" be and the same is hereby repealed.

The senate shall consist of twenty-four, and the house of representatives of forty-nine members, who shall be qualified electors of their respective districts and residents of New Mexico for at least three years next preceding their election. Senators shall not be less than twenty-five, years, and representatives not less than twenty-one years of age at the time of their election. No person shall be eligible to the legislature who, at the time of qualifying, holds any office of trust or profit under the State, county, or National Government, except notaries public and officers of the militia, who receive no salary.
