Until otherwise provided by law, any person violating any of the provisions of section one (1) shall, upon conviction, be punished by a fine of not less than fifty dollars, nor more than one thousand dollars, or shall be imprisoned in the county jail for not less than thirty days nor more than six months, or by both such fine and imprisonment, and upon conviction for a second and subsequent violation of said section such person shall be punished by a fine of not less than one hundred dollars nor more than one thousand dollars, and shall be imprisoned in the county jail or state penitentiary for a term of not less than three months nor more than one year.
